Good thing the Court permitted amicus to argue, because Prof. Nesson's argument didn't advance his case at all. Given the nature of Prof. Nesson's argument, Judge Selya was surprisingly restrained. I'm guessing he just totally disengaged once Prof. Nesson started to go off the reservation.
